Terms of Sale for ATIMODE

Preamble

The following Terms and Conditions of Sale govern all transactions carried out on the ATIMODE website. Any order placed on this site implies the customer’s unconditional and irrevocable acceptance of these terms.

Purpose

This contract is a distance contract that aims to define the rights and obligations of the parties in the context of the online sale of ATIMODE products, through the secure online payment platform of the Interbank Electronic Banking Center.

Definitions

In the remainder of this contract, each of the terms mentioned below shall be understood according to the following definitions:

  • “Distance Contract”: any contract relating to goods or services between ATIMODE and a Consumer within the framework of a distance selling or service provision system organized by ATIMODE, which, for this contract, exclusively uses the Internet network up to and including the conclusion of the contract itself.
  • “Consumer”: any natural person who, in this contract, acts for purposes that do not fall within the scope of their professional activity.
  • “Order Form”: a document indicating the characteristics of the Products ordered by the Consumer and which must be validated by them through a “double click” in order to be binding.
  • “Order”: the act by which the Consumer commits to purchasing Products and ATIMODE commits to delivering them.

Products

All products listed in the catalog are offered for sale while stocks last.

ATIMODE reserves the right to remove any item from the catalog at any time without prior notice. Under no circumstances shall ATIMODE be held liable to compensate or cancel an order due to the inability to use the purchased product as a result of incompatibility with equipment already owned by the buyer.

Placing an Order

After finding the product(s) you are interested in, click on the “Order” button. The product will then be added to your order form.

You can modify your order form at any time and return to the catalog by clicking “Continue Shopping.”

Once you have finished your shopping, confirm your order by clicking the “Pay” button.

In case of an error during the entry of your order, we recommend that you send us a cancellation request by email within 24 hours. Once the order has been canceled by ATIMODE, you may place a new order.

Pricing

The prices listed in the catalog are indicated in Moroccan dirhams, excluding taxes, and are valid at the time they are viewed by the customer. They are those in effect at the time of the order.

VAT is calculated in the order form according to the rate applicable on the day of the order. The order form and all transactions are carried out in Moroccan dirhams.

Any change in the applicable tax rate will be automatically reflected in the price of the products.

Order Fulfillment

The order will be fulfilled within a maximum period of 7 days from the day following the one on which the Consumer placed the order.

In the event that the ordered Product is unavailable, the Consumer will be informed as soon as possible and will have the option to cancel the order.

The Consumer may then choose to request either a refund of the amounts paid, within thirty days at the latest from the date of payment, or an exchange of the Product.

Delivery

Delivery is not handled directly by ATIMODE. The customer will receive their goods at the delivery address indicated on the order form.

Products are delivered to the address provided by the Consumer on the order form. The Consumer is required to check the goods upon delivery and report any damage caused during transport to the carrier on the delivery note, as well as to ATIMODE within one day.


How much does delivery cost?

Shipping costs are the responsibility of the buyer.

In Morocco, they are based on the rates of the selected delivery service for registered shipping.


What are the delivery times?

After receipt of your payment, your order is shipped within 48 hours, subject to product availability.

In Morocco and internationally, items are sent by registered mail.

Any delays shall not give rise to damages, cancellation of the order, or refusal to accept delivery.

Payment Method

To pay for your order, you may choose from the payment methods offered by ATIMODE on the payment page.

In this case, the transaction will be submitted for debit from your account within the day following the confirmation of delivery.

Your online payments are secured by the Interbank Electronic Banking Center (CMI), which provides a fully secure payment service.

The Consumer guarantees ATIMODE that they have the necessary authorizations to use the chosen payment method when validating the order form.

In the case of payment by credit card, the provisions relating to fraudulent use of the payment method, as set out in the agreements between the Consumer and the card issuer, and between ATIMODE and its banking institution, shall apply.

Data Privacy

The information requested from you is necessary for processing your order and is treated confidentially.

You have the right to access and correct your personal data.

Right of Withdrawal

From the date of delivery of your order, you have a period of 5 days to exercise your right of withdrawal and receive a full refund. Return shipping costs remain your responsibility.

However, only items returned in perfect resalable condition, complete and in their original packaging, will be eligible for a refund.

Warranty

All products sold in the catalog are guaranteed against manufacturing defects and material faults. The duration of this warranty is at least one year from the purchase order date.

In the event that returned items are found not to be defective, shipping and handling fees may be charged to the customer.

This warranty does not cover damage resulting from accidents, misuse, or negligence.

Proof of Transactions Paid by Credit Card

Data recorded by the CMI on the online payment platform on behalf of ATIMODE constitutes proof of the commercial transactions carried out between you and ATIMODE.

Force Majeure

ATIMODE shall be required to fulfill its obligations only to the extent that no event of force majeure prevents their performance.
